General Terms and Conditions (GTC) for the purchase of NFTs and GameTokens from DW3 Studio
1. Scope of application
These General Terms and Conditions (GTC) apply to all contracts concluded via the DW3 Studio project.
The project offers customers the opportunity to purchase NFTs (Non-Fungible Tokens) and GameTokens, which can be used in future DW3 Studio games.
These GTC are authoritative for the use of the website and the purchase of digital goods and apply to all future business relationships, even if they are not expressly agreed again.
2. Subject matter of the contract
The subject matter of this contract is the purchase of NFTs and GameTokens.
These digital goods grant the purchaser the right to use them in DW3 Studio's future games.
DW3 Studio does not guarantee or warrant that these NFTs and GameTokens will increase in value in the future or that they will be of any particular use in the game.
The purchase of these digital goods is purely speculative and the purchaser acknowledges that they may not make any financial gain from them.
3. Return and exchange
All purchases of NFTs and GameTokens are final.
There is no right of return and no right to exchange or refund, regardless of the reason.
The buyer acknowledges that they cannot return or exchange these digital goods after purchase, as the nature of NFTs and cryptocurrencies does not allow this.
The buyer should therefore carefully consider whether he/she actually wishes to purchase these digital goods before making a purchase.
4. Affiliate system
DW3 Studio offers an affiliate system where customers can earn commissions by recommending the project. For each successful referral, the customer receives a small commission in the form of USDC (BEP-20).
This system allows customers to earn additional income by referring new buyers for the NFTs and GameTokens.
The exact amount of the commission and the conditions for its payment are described on the DW3 Studio website and can be changed at any time.
5. Payment of the commission
Commissions from the affiliate system are paid out exclusively in USDC (BEP-20).
It is the customer's responsibility to provide a correct BEP-20 address for payment.
If commissions are sent to a non BEP-20 compliant address and are lost as a result, DW3 Studio accepts no liability for this loss.
It is the customer's responsibility to ensure that the address provided is correct and compatible.
6. Risks of the crypto market
The customer is hereby expressly advised that investments in cryptocurrencies and digital goods are associated with considerable risks.
The prices of these digital goods can fluctuate significantly, which can lead to considerable losses.
There is always a risk of complete loss of the invested capital. The buyer should be aware of the risks and only invest funds that he can afford to lose.
DW3 Studio accepts no responsibility for any losses caused by fluctuations in the value of the digital goods.
7. Final provisions
Should individual provisions of these GTC be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
The invalid provision shall be replaced by a legally permissible provision that comes closest to the economic purpose of the invalid provision.
DW3 Studio reserves the right to amend these GTC at any time.
Amendments will be published on the website and come into force upon publication.
It is the customer's responsibility to regularly inform themselves about the current status of the GTC.
